Georgia real estate law mandates that you are a buyer customer unless you enter into a written Buyer Broker Agreement. As a customer, the real estate sales associate is required only to treat you with honesty and reasonable care. There is no one to represent your best interests. If you go to a listing agent to purchase a house/land, the agent is actually legally bound to represent the interests of the seller. At Jayne Hanlon Realty, we do not list property which allows us to have Exclusive Buyer Agents and to specialize in Buyer Agency, which is the strongest form of buyer representation. We believe that if sellers and their agents were required to read Real Estate Buyer Miranda Rights to you, a call to an Exclusive Buyer Agent would be first on your mind. Since Jayne Hanlon Realty does not
work with sellers as clients, we will never work with buyers and sellers as clients in the
same transaction. This eliminates agency conflicts (Dual or Designated
Agency) that can dilute your representation. With Dual Agency an agent is
trying not to give the seller or buyer an advantage so neither client gets the
benefit of pure representation. When Designated Agency is being
practiced, confidentiality and allegiance can be accidentally breached by agents working
in the confines of the same office. Georgia state law prohibits a Broker from representing a Buyer as a client
without first entering into a written agreement with the Buyer (O.C.G.A. §

Georgia Association of REALTORS®' Who pays?The majority of the properties we will show you will be listed under a cooperative brokerage arrangement in a Multiple Listing Service (MLS). This means the commission will be paid from the seller’s proceeds. Here at Jayne Hanlon Realty, we will also show you “For Sale By Owner” properties and new construction. In some cases, we may also show properties that are candidates for sale but are not listed. In cases where a cooperative brokerage arrangement is not available, we will try to negotiate the commission with the seller. We will discuss any properties where seller is not willing to pay the commission prior to the property being shown. In the event the Seller or Listing Broker does not pay our commission, and you agree in writing that you still wish to consider the property, then you pay Jayne Hanlon Realty at closing a pre-negotiated commission based upon a percentage of the purchase price.
